It is overturned through the use of competent evidence that would have to be presented by such person. It must also be noted that the presumption is also applicable only if the records were obtained from the proper sources; hence, there is still the need to prove that fact on the part of the person who would present the records in question.
Copies of the marriage records may be obtained from a number of sources, though admittedly, most people would make the request at the local level as there are fewer records that would have to be checked at this level. The procedure that one could use to make the request would depend on the office where the request would be made, though it would usually be either through the mail or in person. Note that both methods would have their own inherent advantages and disadvantages, and that the local level offices would also have limitations in presenting the records that the person who would make the request would be interested in. Still, as there are fewer records that would have to be checked at this level, a request here would usually be faster.
